Cadastral description

In the event a property or a building is not properly registered in the cadastre, there is the risk that the Land Registry refuses to register an extension of work or a purchase, arguing that proper registration of the concerned property has not been proved.  And such a discrepancy may be even greater in the event that reality does not match the registry and the cadastre either.

In these cases, the available discrepancies must be analysed (ownership, area, boundaries, etc.) so that the incorrect cadastral descriptions may be amended.

The best solution to this problem is to carry out a correct cadastral description of the property by means of a detailed certificate, issued by a competent expert, including an in-depth description of all the situation of the property, especially the cadastral or Land Registry mapping discrepancies.

Then, the amendment of any wrong data must be requested to the General Directorate for Cadastre by the submission of the technical certificate and any relevant additional documentation. In the event the amendments are related to the boundaries, such request must be jointly submitted by all the concerned owners.

Finally, once the cadastral description has been properly amended, the relevant changes must be registered so that the Land Registry matches the reality and the cadastre with the execution of the pertinent notarial deed.

Thus, matching reality with cadastral description and the registry, a problem that could hinder or prevent a purchase operation is solved.
